Council may have acted outside legal powers over councillors' resignations

Minutes from a Bradwell Parish Council meeting show members approved requests from councillors Spencer Vanderpal and Andy Ellis to retract resignations that had been submitted.

The decisions have raised questions over whether the resignations had already taken legal effect, potentially triggering the statutory process for filling casual vacancies.

The issue emerged during the council's meeting on June 29.

According to the published minutes, both Cllr Vanderpal and Cllr Ellis submitted their resignations at the meeting.

However, both councillors later asked for their resignations to be withdrawn.

Members voted by five votes to one to allow Cllr Vanderpal's resignation to be retracted, while Cllr Ellis's request was approved by six votes to one.

A third councillor, Kent Barron, also resigned.

His resignation was noted by the council and no request was made for it to be withdrawn.
