Opinion | Impeachment Motion Against Justice Swaminathan: Don’t Browbeat The Judiciary

The Lok Sabha Speaker has been served with notice of impeachment of Justice G.R. Swaminathan of the Madurai Bench of the Madras High Court, duly signed by more than 100 members of the Lok Sabha and 50 members of the Rajya Sabha, as required under Article 218 of the Constitution, citing proven misbehaviour and incapacity as the grounds for his removal.

The notice would be scrutinised by a three-member committee and, on its approval, it will be voted upon in both the Houses, and the judge in the dock would be removed if approved by two-thirds of both the Houses.

That the impeachment motion is bound to fail, given the arithmetic of the composition of the two Houses, must be evident to everyone, but the purpose is not to remove him but to name and shame him for the Brahminical accoutrements he wears proudly on his forehead — Vibhuti smeared across and middled with vermillion.
