In 2021, prominent ear nose and throat surgeon William Mooney was banned from practising for a year after the NCAT found him to be unethical, to have lied and to have provided substandard medical care.

But last week, the same tribunal that banned the surgeon for lying to authorities cleared the way for Mooney to reapply for his licence, saying he could now be trusted.

The Herald considers the volte-face deeply troubling.

In 2018, our chief investigative reporter Kate McClymont revealed the death of two of Mooney’s patients.

While we are now restricted from detailing personal information about the patients because of a suppression order, McClymont’s reporting on the deaths of a 24-year-old man training to be a pilot (Patient A) and a 41-year-old man (Patient B) raised concerns about the level of Mooney’s care, including mistakes, rushed procedures and post-surgical care.

At the time of their operations, neither patient knew regulators had placed conditions on Mooney’s practising certificate because of allegations of cocaine use.

The stories led to emergency intervention by the NSW Medical Council because of the potential risk to public safety.

The Health Care Complaints Commission subsequently brought action against Mooney at NCAT that found him guilty of professional misconduct and substandard care.
