Showing that states retain certain powers even under the misrule of Donald Trump, Albany Federal Judge Mae D’Agostino has upheld for now New York’s ban on local law enforcement agencies having so-called 287(g) agreements with ICE (which enlist local police into performing civil immigration enforcement functions.)

Late last month, the state sent out letters to 12 local law enforcement agencies with 287(g) agreements informing them that these deals now violate state law and must be terminated. D’Agostino ruled Monday that these bans can move forward, even as she struck down a state-level mask ban. Capping things off, New York has also prohibited localities from entering into contracts to allow ICE to use their jails as part of its inhumane national detention system.
