GOLDSTEIN: One law for SNC-Lavalin, another for the rest of us

Deferred prosecution agreements (DPAs), which lie at the heart of the political scandal engulfing the Trudeau government, are a classic example of the fact there’s one law for the rich and politically connected, another for everyone else.

DPAs were the mechanism by which powerful Wall St. banks and their executives escaped criminal prosecution and jail time for their fraudulent activities in the subprime mortgage scandal that led to the 2008-2009 global recession.

As a result, none went to prison by agreeing to deals in which their companies — not the executives who presided over them — paid billions of dollars in corporate fines, a drop in the bucket compared to their huge profits.

The problem with DPAs is that they potentially create a moral hazard — a lack of any incentive to avoid future wrongdoing because DPAs shelter the wrongdoers from the full legal consequences of........
