Rep. Luna: ‘I think the votes are there’ to expel Swalwell and Gonzales

Rep. Anna Paulina Luna (R-Fla.) said she thinks there is enough support in the House to expel Reps. Eric Swalwell (D-Calif.) and Tony Gonzales (R-Texas), both of whom have been accused of sexual misconduct.

Luna said she would file a motion to expel Swalwell, who has been facing bipartisan calls to step down after a bombshell report from the San Francisco Chronicle that he had allegedly sexually assaulted a former aide of his in 2019 and 2024, both of which happened when the woman was too intoxicated to give consent.

Rep. Teresa Leger Fernandez (D-N.M.) is leading a separate effort to remove Gonzales from office. He admitted to having an affair with one of his congressional staffers. The staffer died after setting herself on fire last year.

“It’s against House rules to have an inappropriate relationship with your staff, and it’s also against House rules to sexually harass your staff. I can’t speak to the criminal allegations regarding Swalwell and rape, but what I can say is, based on the evidence that’s been put forward, I believe CNN has screenshots, etc, and the information that’s come out, he already violated House rules. If he had any sliver of dignity, he would resign,” she said.

Asked whether she thought there would be enough support for both Swalwell and Gonzales resolutions, she said, “I think the votes are there for both.” The resolutions would need to get support from two-thirds of the House to pass. 

“Do you think members are really going to try to protect people that openly admitted to breaking congressional ethics and sexual harassment before the midterms?” she said. 

Many members in both parties have called for both Swalwell and Gonzales to be removed from office, including Reps. Byron Donalds (R-Fla.), Nancy Mace (R-S.C.), Ro Khanna (D-Calif.), Jared Huffman (D-Calif.) and Mike Lawler (R-N.Y.). 

The House Ethics Committee on Monday announced that they were investigating Swalwell, noting that they will gather information on whether he “violated the Code of Official Conduct or any law, rule, regulation, or other applicable standard of conduct in the performance of his duties or the discharge of his responsibilities, with respect to allegations that he may have engaged in sexual misconduct.”

Swalwell suspended his campaign for California governor on Sunday, after House Democratic leaders and other members pressured him to do so. He has denied the allegations.

Gonzales’s affair was reported earlier this year, leading to an Ethics Committee referral and the Texas congressman ending his bid for reelection in March after he acknowledged the affair. Speaker Mike Johnson (R-La.) has long argued in favor of letting the Ethics panel complete its investigations before the chamber takes action to punish members.
