EU: Meta isn’t keeping underage users off Facebook, Instagram

The European Union’s executive branch accused Meta of violating its sweeping digital rules that require technology platforms to minimize the risks of harm for users, including children and young people.

The European Commission, in a report released Wednesday, said Meta has violated the Digital Services Act (DSA) by allegedly failing to identify and prevent minors under 13 from using Facebook and Instagram.

The report states Meta’s terms and conditions “do not seem to be effective,” despite stating they do not allow users under the age of 13 on their platforms. The commission said minors under 13 can enter a false birth date without facing further checks to verify this is true, and when a minor under 13 is reported for being underage, there “often is no proper follow-up.”

“The measures do not adequately prevent minors under the age of 13 from accessing their services nor promptly identify and remove them, if they already gained access,” the report said.
