John Yoo: Supreme Court’s tariff ruling a ‘blessing in disguise’ for Trump

Former U.S. Deputy Assistant Attorney General John Yoo called the Supreme Court’s Friday ruling that struck down the bulk of President Trump’s tariffs a “blessing in disguise” for the president ahead of the 2026 midterms.

Yoo said that if it forces the president to put off the tariffs, it could boost the economy ahead of the midterm elections in a way that could benefit the GOP.

“This might be a blessing in disguise, because we just had GDP [gross domestic product] report numbers from last year that showed the economy significantly slowed,” Yoo said Friday during an interview with Fox News.

“If all the tariffs that the president announced are immediately eliminated, and … if he really chooses to do it again, has to take about a year to impose these tariffs again, that might actually have a positive boost on the economy, which could have a very positive effect on President Trump and Republicans by the midterm elections,” he said.

Trump slammed Supreme Court justices for their decision to knock down his tariffs over his use of the International Emergency Economic Powers Act (IEEPA) to impose them. He called the justices who voted against him “disloyal” and “unpatriotic” to the Constitution during a press briefing he held following the ruling. 

“I don’t want to say whether I regret nominating them. I think their decision was terrible,” Trump told reporters at the White House press briefing. “I think it’s an embarrassment to their families.”

In the last quarter of 2025, the U.S. economy grew far slower than economists anticipated, according to data released Friday by the Bureau of Economic Analysis. The data didn’t specifically link tariffs to the slowing growth, however. The fourth quarter of 2025 was also largely defined by the 43-day government shutdown, which also could have impacted gross domestic product growth. 

Trump has already announced a number of fallback options he plans to implement to continue his tariff regime — including using Section 122 of the 1974 Trade Act to impose a 10 percent universal tariff. But Section 122 has a 150-day limit on its tariffs and some of his other options including Section 301 will require the president to implement investigations to determine foreign countries are restricting U.S. commerce, which could take months. 

This means the president faces a number of barriers to replacing his IEEPA tariffs quickly.

According to Yoo, if tariffs had anything to do with the recent dip in economic growth, the potential for an uptick in the economy leading up to the midterms could help Trump and the GOP.
