On 3rd April 2026, the European Union’s legal framework permitting the detection of Child Sexual Abuse Material (CSAM) expired. This expiry is a critical turning point in the global digital child protection regime. While this development is geographically distant, its implications are immediate and deeply relevant for countries like Pakistan, where legal frameworks for digital protection remain evolving, and enforcement gaps persist. At its core, the EU crisis demonstrates a stark reality: when legal authority for detection disappears, child protection systems weaken instantly.
Since 2021, EU-based online platforms have operated under a temporary legal exemption that allowed them to voluntarily detect, scan, and report abuse material without violating strict privacy laws. This arrangement was always intended as a stopgap measure until a permanent framework could be agreed upon. However, due to political deadlock, a permanent framework could not be developed, leading to its expiry.
It is, however, pertinent to mention that the expiry of the existing framework has not resulted in technological incapacity but in legal paralysis. Platforms continue to possess the technical tools to detect abuse, yet the absence of a clear legal basis now restricts their use, creating what experts describe as a child safety gap where protection is compromised not by lack of capability but by lack of authorisation.
Empirical data highlights the gravity of this gap. During a similar period of legal uncertainty in 2021, reports of child sexual abuse material dropped by 58 per cent. This decline did not indicate a reduction in abuse, but rather a collapse in detection and reporting mechanisms.
Approximately 99 per cent of global reports originate from online platforms using automated detection tools, highlighting their central role in identifying abuse and enabling law enforcement intervention. Without proactive detection, abuse does not cease but becomes invisible. Millions of abuse files and incidents are reported annually, with digital platforms acting as the primary interface between victims and authorities. The removal of legal support for detection, therefore, directly translates into fewer reports, fewer investigations, and fewer victims identified.
Although the legal change is confined to the European Union, its consequences are global. Digital platforms operate across jurisdictions, and regulatory shifts in one region often influence global compliance behaviour. Legal uncertainty in the EU may lead companies to scale back detection systems more broadly, affecting reporting pipelines worldwide.
Given that a significant proportion of abuse cases involve cross-border elements, disruptions in detection in one region weaken enforcement networks globally. This has direct implications for Pakistan, which relies heavily on international reporting systems and cooperation for identifying and addressing online child exploitation.

Pakistan’s digital child protection framework, primarily governed by the Prevention of Electronic Crimes Amendment Act 2025 and implemented through the National Cyber Crime Investigation Agency (NCCIA), provides a foundation for addressing cyber offences, including child exploitation. However, the system remains largely reactive, dependent on survivor complaints, individual reporting, and post-incident investigation.
In contrast to the proactive detection model previously enabled in the EU, Pakistan does not yet have a clearly articulated legal framework that mandates or enables platforms to systematically detect and report abuse material. This reliance on complaint-based mechanisms is particularly problematic in a context where stigma, fear, lack of awareness, and social pressures already suppress reporting.
The absence of proactive detection means that a significant number of cases may never enter the legal system at all. The EU experience highlights several critical gaps in Pakistan’s approach as well.
First, sole reliance on complaint-driven systems fails to capture the reality that self-reporting is a serious barrier in some societies. Second, there is a lack of clarity regarding platform obligations. Pakistani law does not explicitly define whether platforms are required to detect or report abuse material, nor does it provide a clear legal shield for proactive monitoring.
This ambiguity leads to inconsistent cooperation between platforms and law enforcement agencies. According to a recent United Nations Development Programme report on tech-facilitated gender-based violence in Pakistan, 65 per cent of cybercrime cases do not reach any meaningful outcome in Pakistan, and platform non-cooperation is one of the major reasons behind this figure.
Another report on tech-facilitated gender-based violence by the United Nations Population Fund highlighted that compliance levels vary sharply across platforms. Meta platforms, including Facebook, Instagram, and WhatsApp, demonstrate approximately 75 per cent compliance, whereas TikTok shows only 16.3 per cent compliance, and X maintains 0 per cent compliance with data requests from Pakistani authorities.
Third, emerging threats such as artificial intelligence-generated abuse material, online grooming, and live-streamed exploitation are evolving faster than existing legal frameworks, creating additional vulnerabilities, especially in developing countries like Pakistan and against vulnerable segments of society, such as children.
The situation also brings into focus a fundamental human rights tension between privacy and protection. The EU deadlock arose from concerns that detection mechanisms, particularly in private or encrypted communications, may infringe upon privacy rights. However, the absence of a workable legal balance has resulted in reduced protection for children.
This illustrates that failure to reconcile competing rights does not produce neutrality but rather shifts the burden onto the most vulnerable. Pakistan, which is in the process of strengthening its data protection and digital governance frameworks, is already confronting similar tensions whereby women, transgender persons, religious minorities, and children stand at the frontline of this tension.
Existing legal and policy frameworks, including the Digital Nation Act 2025, do not yet adequately safeguard these groups, thereby risking further marginalisation in digital spaces. It is therefore essential to develop a balanced legal approach that safeguards privacy while enabling effective child protection measures.
For Pakistan, the implications are both cautionary and instructive. Legal clarity is essential to ensure that enforcement agencies and digital platforms can act without fear of overstepping legal boundaries. Proactive detection mechanisms, with appropriate safeguards, must not only be explored but also ensured to complement complaint-based systems.
Institutional coordination between key actors such as the NCCIA, the Pakistan Telecommunication Authority (PTA), and child protection bodies such as the National Commission on the Rights of the Child (NCRC) must be strengthened to ensure a coherent response. Technological tools for reporting and redress, including digital complaint platforms, should be expanded and integrated into broader enforcement frameworks.
At the same time, Pakistan must align its domestic legal framework with its international obligations under the Convention on the Rights of the Child and International Labour Organization Conventions 138 and 182, which require effective measures to prevent exploitation and ensure timely identification and protection of survivors.
The EU’s current situation serves as a powerful reminder for Pakistan that child protection in the digital age depends not only on technological capacity but on the legal frameworks that enable or constrain its use. When detection is restricted, abuse becomes harder to identify, investigate, and prevent.
For Pakistan, this moment offers an opportunity to act proactively rather than reactively. By addressing existing legal ambiguities, strengthening institutional mechanisms, and embracing a balanced rights-based approach, Pakistan can build a resilient and effective system for protecting children in digital spaces.
The lesson is clear: in the absence of legal authorisation, even the most advanced tools cannot function, and without detection, protection itself is fundamentally compromised.
