Staff at Bay Area market died of carbon monoxide exposure, lawsuit says

A lawsuit has been filed against the owners of La Tapatia Market in Vallejo following the deaths of two employees, allegedly from carbon monoxide exposure. 

The owners of a Bay Area market have been accused of negligence following the death of two employees who were exposed to carbon monoxide at one of their grocery stores, a lawsuit alleges.  

The complaint, which was filed in Napa County Superior Court on Oct. 30, alleges that La Tapatia Market owners and brothers Ismael Magallanes and Ignacio Magallanes failed to protect employees from repeated carbon monoxide exposure in their store at 601 Broadway St. in Vallejo. The lawsuit was filed on behalf of several La Tapatia employees and the surviving family members of one of the deceased employees. It alleges that staff were not compensated for overtime work and did not receive employment benefits due to cash payments.

“Defendants showed complete indifference to California safety laws designed to prevent carbon monoxide accumulation, allowing illegal sources of carbon monoxide to be installed and present on the premises and failing to properly vent the building,” the lawsuit said.
