'What are judges doing': How courts project racism where it doesn't exist

Jamie Sarkonak explains why she won't stop scrutinizing the progressive judiciary

A recent National Post column has prompted a warning from the Canadian Bar Association (CBA) and sparked a debate around the sentencing in the justice system and the extent to which Canadians – and the media in particular – are able to scrutinize and criticize those making these decisions. In this interview, Rob Breakenridge speaks with National Post columnist Jamie Sarkonak about her recent column on the growing reliance on racial considerations in decisions around evidence and sentencing, and the influential role played by Faisal Mirza, a former lawyer who now sits as an Ontario Superior Court judge.

The CBA responded to that column with a news release that “warns the media on dangers of delegitimizing judges.” Canadians, though, have a vested interest in matters pertaining to the justice system and the media has a duty to keep the public informed, which means scrutiny and criticism. We’ll get Jamie’s reaction to the backlash against her piece and why there’s an important conversation to be had around the issue of race-based sentencing. Watch the full video directly below.
