I know getting the infrastructure bill passed is important work. If we don’t want to see it shredded two years after its implementation, however, I would modestly suggest that the democratically controlled Senate get on the stick with confirming President Joe Biden’s federal judge nominees, before it’s too late.

Sen. Mitch McConnell made the best of what he possibly could with a working Republican Senate majority during Trump’s four wretched years in office. Trump managed to appoint a total of 245 judges to the federal courts, including the District Courts, U.S. Courts of Appeal, and the U.S. Supreme Court. Several of those judges were rated as unqualified by the American Bar Association (ABA), a fact that made absolutely no difference to McConnell; all he cared about were the numbers. During Trump’s tenure, 187 of his nominees were rated as “well-qualified,” while 67 were rated a tier lower as “qualified.” Ten were rated as unqualified.

But that is rather misleading. The fact that a judge is qualified by the ABA does not necessarily speak to one’s political predispositions; to the extent political bias is examined, it is merged (some would say buried) with a metric the ABA uses........
