Maricopa County Superior Court Judge Frank Moskowitz decided that he would not nullify the votes of millions of Arizona citizens and negate the work of those who collected hundreds of thousands of signatures to put the Make Elections Fair Act (now called Proposition 140) on the November ballot.
But … the Arizona Supreme Court still could do just that.
It would be grotesque. It would be wrong.
But this is the court that validated the barbaric 1864 abortion ban (for which two justices face a retention vote.)
And the court already ignored 80 years of precedent by sending a challenge to the proposition to Moskowitz after the deadline for printing ballots had passed.
The Make Elections Fair Act would flush Arizona’s partisan primary election system down the toilet.
